Conveyancing

It is the legal and administrative process of Buying & Selling property and land. Usually this is carried out by a solicitor and takes 4 - 8 weeks for the process to be completed. We have bought property for clients where no finance was required in little as 2 days.

Legal

Title

There are two main types of property title commonly known as freehold and leasehold. There are other types such as share of freehold.

Freehold - This is a superior title to Leasehold in so far that you usually own the property and the land which it is situated on. It is in most cases only subject to mortgages, charges, covenants and details of these are found on the title document as supplied by the Land Registry. (Usually whole houses)

Leasehold - This is not quite as good as freehold but you usually own a right to the property on a piece of land. You usually do not own the land which the building is situated on. It is usual for you to be answerable to a Landlord (the freeholder) who may collect ground rent. It is usual for restrictions to be imposed on the conduct of a leaseholder. (Usually flats / house conversions)

You will have to pay a land registration fee based on the value of the property.

Searches

We always offer advice on what searches you should carry out before buying a property. There are many things to check but the main ones are contamination of land, flood risk to the property, local authority search.

For example this site allows you to check the proximity of a property to a flood risk (by postcode).
